Supreme Court Explains Bail Orders Should Cite Specific Reasons for Being Granted or Refused - 06.12.2019

Supreme Court has noted that Courts should give specific reasons while granting or denying bail as the issue concerns both the liberty of the Accused and ensuring that the offender does not obstruct the delivery of justice. The Court said that open justice is premised on the notion that it should not only be done, but should “manifestly and undoubtedly” be seen to be done and the duty of judges to give reasoned decisions lies at the heart of this commitment.

Parliament Passes Bill to Give Ownership Rights to Residents of Unauthorised Colonies in Delhi - 05.12.2019

Parliament has passed a bill to grant ownership rights to residents living in 1,731 unauthorised colonies in Delhi. The National Capital Territory of Delhi (Recognition of Property Rights of Residents in Unauthorised Colonies) Bill, 2019 was passed by a voice vote in Rajya Sabha. It was already passed in Lok Sabha on November 28.

SAT Declines Relief to Lenders in Karvy Case - 05.12.2019

Securities Appellate Tribunal has refused to give any further relief to HDFC Bank, ICICI Bank, Bajaj Finance and Indusind Bank in Karvy Broking share pledge case. The Tribunal asked these companies to approach Securities and Exchange Board of India by December 6 with their pleas. Further it directed the markets regulator to pass an order in the matter by December 12.

ITAT Delhi: Section 36(1)(vii) Applicable in Inability or Insolvency Cases - 05.12.2019

Income Tax Appellate Tribunal, Delhi has held that an Assessee is entitled to claim under Section 36(1)(vii) of the Income Tax Act where the money is unable to be recovered due to inability or insolvency of the debtor to pay. In all other cases, the claim for allowance should have to be sustained under Section 37(1).

Bombay High Court Rejects Mehul Choksi's Plea to Stay Case Against Him in Special Court - 04.12.2019

Bombay High Court has refused to stay a Special Court's proceedings to declare diamond businessmen Mehul Choksi, an accused in the USD 2 billion Punjab National Bank fraud case, a fugitive economic offender. The Enforcement Directorate, which is probing the case, had earlier moved an application before a Special Court in Mumbai to declare Mehul Choksi a fugitive economic offender under provisions of the Fugitive Economic Offenders Act, 2018.

Delhi High Court Refuses to Direct AAP Government on Kanhaiya Kumar's Prosecution - 04.12.2019

SAT to SEBI: Hear Bajaj Finance Plea - 04.12.2019

Securities Appellate Tribunal has asked the Securities and Exchange Board of India to hear Bajaj Finance’s plea against the capital market regulator, which had asked depositories to return the majority of client shares pledged by Karvy Stock Broking with its lenders. SAT has restrained National Securities Depository Ltd from transferring the balance of the pledged shares back to Karvy’s clients.

ITAT Delhi: Excessive Application of Net Profit Rate is Not Admissible - 04.12.2019

Income Tax Appellate Tribunal, Delhi has ruled that in earlier assessment years as well as in subsequent assessment years, a particular net profit rate has been applied which can be applied by the Revenue. Application of net profit rate of 12% by the authorities is excessive and unreasonable.

Supreme Court Grants Bail to P Chidambaram - 04.12.2019

Supreme Court has granted bail to P Chidambaram in the INX Media money laundering case. The former Union Minister has spent 105 days in prison, mostly in Delhi's Tihar Jail. However the Court said that Mr Chidambaram cannot leave the country and has to present himself for questioning whenever required.

Calcutta High Court Lifts Stay on Asset Sales of Eveready and McLeod Russel - 03.12.2019

Calcutta High Court has lifted its temporary injunction on the sale of assets by group companies McLeod Russel and Eveready Industries. Eveready has been monetising land parcels and McLeod has been selling tea estates to pare their debts. Rajya Sabha Passes Bill Seeking Ban on E-Cigarettes - 03.12.2019

Rajya Sabha has passed the Prohibition of Electronic Cigarettes (Production, Manufacture, Import, Export, Transport, Sale, Distribution, Storage and Advertisement) Bill, 2019. The Bill that was passed with voice vote in upper house has already received a nod from the Lok Sabha and is set to receive the President’s assent to become an Act.

Apex Court Stays Death Penalty of Rajasthan Blast Case Convict - 03.12.2019

Apex Court has stayed the execution of death penalty awarded to a convict in the 23-year-old case of bomb blast in a bus in Rajasthan's Dausa district in which 14 persons were killed. The Court ordered that Abdul Hameed be not executed until further orders and agreed to hear his appeal against the Rajasthan High Court judgment upholding his death penalty in the 1996 terror attack case.

Apex Court Directs NBCC to Complete 8 Projects in Noida and Greater Noida - 03.12.2019

Apex Court has directed National Buildings Construction Corporation Ltd to commence and complete the work of eight projects involving 11,258 home units in Noida and Greater Noida and start handing over possession to the buyers. The Court asked NBCC (India) Ltd to complete the unfinished projects in Noida and Greater Noida - Zodiac, Sapphire 1 and 2, Silicon City 1 and 2, Princely Estate, Centurion Park Low Rise and the O2 Valley.

Delhi High Court Directs Equal Clothing, Washing Allowance for Employees - 02.12.2019

Delhi High Court has directed that all its employees will be paid an equal amount of clothing and dress maintenance allowance saying there is no justification for discrimination. The Court dismissed the explanation given by the Counsel representing the High Court that officials directly assisting judges inside Courts "are required to maintain decorum and discipline of the court by wearing the prescribed uniform".
