Bombay High Court Restrains DHFL Promoters from Going Abroad over Dues Worth Rs 200 Crore - 08.11.2019

Bombay High Court has restrained Dewan Housing Finance Corporation Ltd (DHFL) promoters Dheeraj Wadhawan and Kapil Wadhawan from leaving the country until further orders, in a plea filed by 63 Moons Technologies seeking recovery of around Rs 200 crore dues. The Court noted that the Wadhawans will have to seek permission from the High Court if they wish to leave the country.

Federal-Mogul Open Offer Case: SAT Rejects Tenneco Appeal, Asks to Deposit Amount Within 4 Weeks - 08.11.2019

NGT Slams MoEF for Delay in Issuing Notification to Ban RO Purifiers - 07.11.2019

National Green Tribunal has slammed the Environment Ministry (MoEF) for the delay in issuing a notification to ban RO purifiers where total dissolved solids in water are below 500 milligrams per litre and warned the officer concerned of stopping his salary. The Tribunal said that the delay in compliance of its order is causing harm to public health and environment.

Supreme Court: HC while Exercising Revisional Jurisdiction can Condone Delay - 07.11.2019

Supreme Court has held that the provisions of Section 5 of the Limitation Act, 1963 are applicable on High Court while exercising revisional power since there is no express exclusion of the Limitation Act by the provisions of Himachal Pradesh Value Added Tax Act, 2005.

SC Clarifies Section 144 CPC not Attracted when there is no Variation or Reversal of Decree or Order - 06.11.2019

Supreme Court has observed that the provisions of Section 144 of Code of Civil Procedure, 1908 will not be attracted when there is no variation or reversal of a decree or order. The Court noted that the principle of doctrine of restitution is that on the reversal of the decree, the law imposes an obligation on the party to the suit who received the benefit of the decree to make restitution to the other party for what he has lost.

SEBI Increases Governance Norms for Rating Agencies - 05.11.2019

Securities and Exchange Board of India has said that the Chief Executive Officer of a rating firm cannot be a member of the rating committee and such committees will directly report to the chief rating officer. The capital markets regulator also said that independent directors should constitute one-third of the board of the rating agency.
