Supreme Court: Arbitration Right Remains Despite Arbitration Clause Becoming Inoperable - 09.10.2025
SC held that if an arbitration clause becomes inoperable, such as naming an ineligible arbitrator under Section 12(5) of the Arbitration Act, it does not invalidate the arbitration agreement. The Court can appoint a neutral arbitrator under Section 11(6) to ensure arbitration proceeds effectively.
