Delhi High Court: Woman’s Ability to Earn Not a Ground to Deny Her Maintenance - 10.06.2019

Delhi High Court has observed while broadening the welfare scope of Protection of Women from Domestic Violence Act, 2005 that the mere fact that a woman is capable of earning cannot be used as grounds to deny her maintenance. The High Court has held that in a case where a wife’s working status is disputed, the Court cannot assume that because she is educated, or was employed prior to her marriage, she would again be gainfully employed.
