SC: Court Can Exempt Accused from Personal Appearance Before Grant of Bail - 03.05.2024

Supreme Court has observed that power to grant exemption from personal appearance under the Code of Criminal Procedure should not be read in a restrictive manner and the accused can be exempted from showing his personal appearance before the court, even before, the grant of bail.

SC: IO to Make Clear & Complete Entries in Chargesheet, Role Played by Each Accused to be Mentioned - 02.05.2024

SC has held that the investigating officer (IO) must make clear and complete entries in chargesheet so that the court can clearly understand which crime has been committed by which accused and the role played by each accused in the crime should be separately and clearly mentioned in the chargesheet.

SC: Stamp Duty Can be Imposed by State on Insurance Policies Executed Within State - 02.05.2024

Supreme Court while rejecting appeals filed by Life Insurance Corporation against a demand of stamp duty of Rs. 1.19 crore by the State, has held that the State Government can impose stamp duty on the issuance of insurance policies within its territory and require the payment of such stamp duty.

SC: HC’s Decision Allowing Amendment of Cheque Date Mentioned in Complaint, Set Aside - 02.05.2024

SC held that in a matter, where date is a relevant aspect based on which entire aspect relating to issue of notice within time frame is provided under NI Act, 1881, and also as to whether as on date there was enough balance in the account of issuer of cheque, the amendment would not be justified.

Ker. HC: Payment of Interest Can’t be Reviewed or Added While Enforcing Foreign Award - 01.05.2024

Ker. HC has held that the executing court cannot review a foreign award or add anything to it. Moreover, the executing court cannot go behind the decree sought to be executed. The foreign award is a deemed decree and no provision for payment of interest can be read into the award/decree.
