SC: Government Officers to First Appear Virtually, if Court Thinks Their Presence to be Necessary - 25.04.2024

SC while expressing disapproval at practice of High Courts routinely ordering personal appearance of Government Officials, has observed that if High Courts think that it is necessary to direct personal appearance of the official, they should first allow them to appear through video conferencing.

SC: Can Only Apply Egg Shell Skull Rule if Patient Had Pre-Existing Conditions - 25.04.2024

Supreme Court While enhancing the compensation amount for a patient from Rs. 2 Lakh to Rs. 5 Lakh, has observed that the egg shell skull rule that holds the injurer liable for damages suffered, shall only be applicable if the patient had pre-existing conditions.

Raj. HC: Impermissible for Mag. & ASJ to Take Cognizance Against Same Accused for Diff. Offences - 25.04.2024

Raj HC has held that a conjoint reading of Section 193 and 209 of Code of Criminal Procedure, 1973 would make it clear that situation wherein part cognizance has been taken by the Magistrate and part cognizance has been taken by the Additional Sessions Judge cannot be held to be legally permissible.
