Del HC: Invoking Penalty Proc. Based on NFAC’s Own Failure to Lodge Claim Can’t be Sustained by them - 19.04.2024

Delhi High Court has held that invocation of penalty proceedings that are based on the National Faceless Assessment Centre’s (NFAC) own failure to lodge a claim on time under the Insolvency and Bankruptcy Code, 2016 (IBC) cannot be sustained by them.

SC: In Absence of Special Court for UAPA Cases, Sessions Court Will Have Jurisdiction to Try them - 19.04.2024

Supreme Court has held that the Court of Sessions will have the jurisdiction to try offences punishable under the Unlawful Activities (Prevention) Act, 1967 (UAPA) in the absence of a special court designated by the State Government.

Del. HC Directs Dept. to Remove Demands From ITBA Portal as it Fails to Comply with ITAT's Order - 19.04.2024

Allahabad HC: In Execution Proceedings, Challenge Cannot be Made to Arbitral Award u/s 47 of CPC - 18.04.2024

HC has held that in execution proceedings under Section 36 of Arbitration and Conciliation Act, 1996, questions to be decided are limited to matter related to execution of decree and Court cannot go into validity of decree under Section 47 of Code of Civil Procedure, 1908 at stage of execution.

Supreme Court: Enable E-Filing & Virtual Appearance Facilities At UP District Courts - 16.04.2024

Supreme Court has asked the Registrar General of the Allahabad High Court that e-filing facility must be enabled at the e-Sewa Kendras of the District Courts of Uttar Pradesh along with the facility of e-affidavit. The litigant/lawyer must appear 'in person' at the e-Sewa Kendra for e-filing.

Bom HC: Person Cannot be Deprived of Right to Sleep by Recording Statements at Unearthly Hours - 16.04.2024

Bom. HC while observing that recording of statement, at unearthly hours, results in deprivation of a person’s sleep, a basic human right of an individual, has directed the Enforcement Directorate to issue circular/directions, as to the timings, for recording of statements.
