Delhi High Court Asks Govt, Police to Ensure Lighting in Subways and Patrolling on Foot-Over-Bridges - 06.09.2019

Delhi High Court has directed authorities to ensure adequate lighting in subways and police patrolling on foot-over-bridges in the national capital so that they are not misused by miscreants.The Court noted that the public use these subways and foot-over-bridges extensively and these places should be kept clean and open for them.

Supreme Court Permits Iltija Mufti to Meet her Mother Mehbooba - 06.09.2019

Supreme Court has allowed Iltija Mufti to meet her detained mother, former Jammu and Kashmir Chief Minister Mehbooba Mufti, in Srinagar. However when she asked the Court’s permission to move around in Jammu and Kashmir, Chief Justice of India Ranjan orally remarked, “Why do you want to move around? It is very cold in Srinagar”. Though the Court later recorded that she could move the district authorities for permission to move around.

SC: Legal Metrology Act Eliminates Only Those Offence with Regard to Weight or Measure under IPC - 05.09.2019

Supreme Court has ruled that though Section 3 of the Legal Metrology Act, 2009 completely overrides the provisions of Chapter 13 of the Indian Penal Code, 1860 in respect of the offences and penalties with regard to weight or measure but the prosecution for other offences under IPC could be maintained.

SC: High Court Cannot Impede in Manner of Investigation in Exercise of Powers under Section 482 CrPC - 05.09.2019

Supreme Court has reiterated that the High Court while exercising jurisdiction under Section 482 of the Code of Criminal Procedure, 1973(CrPC) cannot interfere in the manner of investigation. The Allahabad High Court while disposing off a petition under Section 482 of CrPC had issued a number of directions including the direction to change the erring officers named in the supplementary report to disciplinary action.

INX Media Case: Supreme Court Dismisses Chidambaram’s Plea to Grant Him Anticipatory Bail - 05.09.2019

Supreme Court has rejected former finance minister P Chidambaram’s plea challenging the Delhi High Court’s refusal to grant him anticipatory bail in a money laundering case. The Apex Court upheld the Enforcement Directorate’s contention that Chidambaram’s custodial interrogation was necessary. The Court said “this was not a fit case for granting anticipatory bail and giving the relief now would hamper investigations”.
