IN THE HIGH COURT OF DELHI

CM (M) 821/2009

Decided On: 27.08.2015

Appellants: HK Vs. Respondent: PK

Hon'ble Judges/Coram:
Vipin Sanghi

ORDER

Vipin Sanghi, J.

C.M. No. 5267/2015

1. Mr. Karan Mehta appears for Mr. Viraj Datar, Standing Counsel for Delhi High Court. He submits that since the High Court is a Court of record, the judgments are normally uploaded on the website. However, he submits that the Delhi High Court has no objection to a direction being issued in a case like the present where proceedings arise out of matrimonial dispute between the parties. He also states that in relation to the proceedings before the Family Courts, the Delhi High Court has issued directions that its proceedings shall not be uploaded on the website.

2. My attention has also been drawn to an order passed by this Court with the title "X (Ms.) Vs. State of NCT of Delhi & Another", where this Court protected the privacy of the name of the victim/complainant and, therefore, the name of the complainant/petitioner was not disclosed in the judgment rendered by this Court.

3. Accordingly, I direct that in all the matrimonial disputes and guardianship disputes which fall within the jurisdiction of the Family Courts, the names of the parties be effaced in the cause title and in other parts of the judgment as and when they are uploaded on the website of the Delhi High Court. The same be replaced by the first character of the spelling of their names.

4. It is pointed out by learned counsel, that children of the parties are facing harassment since their names also figure on the body of the judgment and a search on the Internet with their names shows up the judgment of this Court.

5. In view of the peculiar problems being faced by the children of the parties, I direct that, in the present case, the names of the children be also effaced, and be substituted with the first character of the spelling of their names. The modification be made on the official website of the Delhi High Court within a week.

6. The application stands disposed of.
