NCLAT: Oppression & Mismanagement Petition Cannot Be Filed Without Company Membership on Filing Date - 26.12.2025

NCLAT Chennai reaffirmed that a petition alleging oppression and mismanagement under Sections 241 and 244 of the Companies Act, 2013, is not maintainable unless the filer proves they were a company member on the petition’s filing date.
