NCLAT: Issuing Cheques For Another Entity’s Liabilities Does not Constitute Operational Debt - 15.12.2025

NCLAT, New Delhi, held that issuing cheques for another entity’s dues does not justify insolvency in the absence of a direct contract with the creditor, and set aside the NCLT order admitting Nayati Healthcare and Research NCR Pvt. Ltd. into insolvency over alleged unpaid dues.
