Bombay HC: SARFAESI Sale Invalid if Sale Certificate is Not Issued Prior to IBC Moratorium - 12.12.2025

Bombay High Court held that once an interim IBC moratorium is in place, a secured creditor cannot proceed with a SARFAESI sale. It ruled that Union Bank of India could not accept balance payments or issue a sale certificate after the borrower’s personal insolvency process had begun.
