Allahabad HC: Police Report in Non-Cognizable Offence is a Complaint; Accused Must Be Heard First - 27.11.2025

Allahabad High Court recently held that a charge-sheet filed for a non-cognizable offence must be treated by the Magistrate as a ‘complaint’ rather than a police or state case, in line with the Explanation to Section 2(1)(h) of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS).
