Supreme Court: Counterclaim under Order 8 Rule 6A CPC Allowed Only Against Plaintiff - 13.11.2025

Supreme Court reiterated that a defendant cannot file a counterclaim against co-defendants. It clarified that under Order 8 Rule 6A CPC, a counterclaim can only be filed against the plaintiff on a cause of action connected with the cause of action in the plaintiff’s original suit.
