Supreme Court: Pre-Litigation Mediation Not Required for Cases of Continuing IPR Infringement - 28.10.2025

Supreme Court held that pre-litigation mediation under Section 12A of the Commercial Courts Act is not mandatory in cases of continuing IPR infringement, noting that enforcing it mechanically would deny plaintiffs an effective remedy and allow infringers to continue benefiting from violations.
