NCLAT: NCLT Cannot Approve Resolution Plan if Leasehold Rights over Primary Assets are Unproven - 23.09.2025

NCLAT New Delhi bench upheld the NCLT Kolkata order refusing to sanction a resolution plan involving disputed land. The corporate debtor failed to prove leasehold rights as the deed was executed by unauthorized persons, lacked payment proof, and was void, so the resolution plan was not approved.
