Supreme Court observed that barring non-Muslims from creating waqfs is not arbitrary, as they can donate property by forming charitable trusts. The bench stayed provisions of the Waqf (Amendment) Act, 2025, including the requirement of practicing Islam for five years to dedicate property as waqf.
