Del. HC: Can’t Reject TM Owner’s Claim Merely because Defendant Could have Sought Removal of Mark - 04.07.2025

Delhi High Court has clarified that Court cannot reject a registered trademark owner's claim against infringement merely on the ground that the defendant could possibly institute proceedings for cancellation of the asserted mark of the plaintiff.
