Calcutta HC: Cannot Implead Arbitrator in Application u/s 36(2) of A&C Act Unless Fraud Established - 23.06.2025

Calcutta High Court has held that in an application under Section 36 of Arbitration and Conciliation Act, 1996 the Arbitrator need not be impleaded as a party unless the Court upon examination finds that the award was procured through fraud or corruption.
