SC: Where Serviceman Discharged from duty by Authority Onus of Proving Disability Lies on Authority - 09.05.2025

SC has observed that in a situation, where the serviceman himself had not applied for discharge from service due to disability, but has been discharged by the authority, the onus of proving the disability and grounds of denying disability pension would lie heavily on the authority.
