SC: In Absence of Express Law, Determination of Applicable Law Must be on Basis of Intention - 19.03.2025

Supreme Court has observed that if there is absence of an express law that governs the arbitration agreement, the determination of applicable law should be on the basis of parties’ intentions with a strong presumption in favor of the law governing the main contract.
