NCLAT: Cannot Seek Relief u/s 60(5) of IBC when Remedy u/s 42 is Not Exhausted - 24.02.2025

NCLAT New Delhi bench has held that relief against rejection of claims by the liquidator cannot be claimed under section 60(5) of the Insolvency and Bankruptcy Code, 2016 (IBC) when remedy under Section 42 of IBC has not been exhausted.
