SC: Filing Complaint u/s 138 of NI Act through Power of Attorney is Legal & Competent - 03.01.2025

SC has held that filing of complaint petition under S. 138 of NI Act through power of attorney (POA) is perfectly legal and competent. However, the POA holder must have witnessed the transaction as an agent of the payee/holder in due course or possess due knowledge regarding the said transactions.
