Ker. HC: Sexual Intercourse Which is Not the Outcome of Misconception of Fact is Not Rape - 17.07.2024

Kerala High Court while considering quashment of a criminal proceeding initiated against a man for raping a woman, has observed that if the materials show that the sexual relationship between two individuals is purely consensual without an element of misconception of fact, the same is not rape.
