Bom HC: Can’t Register Similar TM for Drug Treating Similar Ailment But Having Different Composition - 18.06.2024

Bom. HC has held that trademarks that are structurally and phonetically similar cannot be registered for drugs treating similar ailment but having different composition from already registered mark as there is a threat of confusion amongst consumers which might lead to potential side effects.
