P&H HC: Presence of Magistrate Mandatory to Prove Compliance With Section 52A of the NDPS Act - 29.05.2024

P&H HC while acquitting a man in a drugs case, has observed that, for proper compliance with Section 52A of Narcotic Drugs and Psychotropic Substances Act, 1985 (NDPS Act) presence of a Magistrate is mandatory and merely showing sample was drawn in presence of Gazetted Officer is not sufficient.
