SC: Can’t Convict Accused For Keeping Narcotics if Mandate u/s 52 of NDPS Act Not Fulfilled by Police - 04.03.2024

Supreme Court has held that if no proceedings under Section 52A of the Narcotic Drugs and Psychotropic Substances Act, 1985 (NDPS) are undertaken by the Investigating Officer then the accused cannot be convicted for possessing narcotics and psychotropic substances.
