Bom HC: Merely Touching Penis to Private Part of Child Doesn’t Constitute Penetrative Sexual Assault - 05.02.2024

Bombay High Court while reducing the sentence of the convicts held that the mere touching of the child’s vagina with accused’s penis would not constitute penetrative sexual assault under Sections 4 & 6 of the Protection of Children from Sexual Offences (POCSO) Act.
