Supreme Court while citing the landmark judgment of Sharad BirdhiChand Sarda v. State of Maharashtra (MANU/SC/0111/1984
) has reiterated the 4 crucial circumstances to be proved in case of murder by poison i.e. Clear Motive to give poison, Death due to poison, poison given by accused and opportunity.
