All. HC: Prelim. Inquiry can be Ordered if Appln u/s 156(3) CrPC Doesn’t Disclose Cognizable Offence - 09.11.2023

Allahabad High Court has held that if the application u/S 156(3) Cr.P.C, filed before Magistrate, in the considered opinion of the Magistrate, doesn’t discloses the cognizable offence per se, the Magistrate has discretion to direct a preliminary inquiry before directing the registration of the FIR.
