All. HC: Wife Residing Abroad Can’t Invoke Jurisdiction of Court Under HMA Where She Briefly Visited - 01.11.2023

Allahabad High Court while hearing an appeal of wife residing in Australia, has held that the term ‘residing’ used in Section 19 of Hindu Marriage Act denotes more than a casual visit to a place falling within the territorial jurisdiction of the Court where a divorce proceeding may be instituted.
