Ker. HC: No Absolute Bar on Grant of Anticipatory Bail in Cases of Rape Against Minors - 21.09.2023

Kerala High Court while observing that that exclusion of provision for pre-arrest bail embodied in Section 438(4) of CrPC in case of rape against minor is not absolute, has held that there will be no protection available to innocent persons if the exclusion is treated as absolute.
