Del. HC: Proprietor of TM Must Establish Valid Registration to Claim Relief Against Infringement - 18.08.2023

Delhi High Court has held that as per Section 28(1) of Trade Marks Act, in order to enjoy the fruits of registration, whether in the form of a right to exclusivity or protection against infringement, the proprietor of the trademark (TM) has necessarily to establish that the registration is valid.
