SC: Penetrative Sexual Assault Against Child Below 12 Years is Aggravated Sexual Assault - 06.07.2023

Supreme Court while observing that if accused commits ‘penetrative sexual assault’ on a child below twelve years it is ‘aggravated penetrative sexual assault’, has held that statute leaves no discretion to the Court and there is no option but to impose the minimum sentence as prescribed under POCSO.
