Del HC: Can’t Restrict Discretion to Choose HC or Session Court for Anticipatory Bail Plea - 12.06.2023

Delhi High Court has held that it is discretionary for the Applicant either to approach the High Court or the Court of Session since both the Court have concurrent jurisdiction and the same cannot be restricted by construing the provision of Section 438 of CrPC narrowly.
