Bom HC: If Design Already in Public Domain, Registration is Prima Facie Liable for Cancellation - 07.06.2023

Bombay High Court has observed that if a design is in the public domain, or is indistinguishable from known designs, the registration itself cannot be granted and if any such registration is granted, it can be cancelled as per section 19 of Designs Act, 2000.
