Gau. HC: Consensual Relationship and Failure to Prove Victim is Minor, Ground for Bail Under POCSO - 11.05.2023

Gauhati High Court while setting aside conviction of an accused under Section 6 of POCSO Act, has held that in cases where the prosecution fails in proving that the victim is a minor and the relationship was not consensual, bail can be granted to the accused.
