SC: Arbitration Agreement in Unstamped Contract Which is Exigible to Stamp Duty Not Enforceable - 25.04.2023

Supreme Court Constitution Bench has held that instrument which is exigible to stamp duty may contain arbitration clause and which is not stamped can’t be said to be contract enforceable in law within meaning of Section 2(h) of Contract Act and is not enforceable under Section 2(g) of Contract Act.
