SC: Application for Withdrawal of CIRP is Maintainable Prior to Constitution of CoC - 29.03.2023

Supreme Court has held that Section 12A of the Insolvency and Bankruptcy Code, 2016 does not debar entertaining applications for withdrawal of Corporate Insolvency Resolution Process (CIRP) even before constitution of the Committee of Creditors (CoC).
