Ker. HC: Sale Under SARFAESI Won’t Extinguish Prior Existing Charge for Dues Under State Tax Laws - 10.01.2023

Kerala High Court has held that statutory charge created under Kerala General Sales Tax Act, and Kerala VAT Act, prior to any mortgage made, against the dealers would remain intact, even if the property is sold by Bank under SARFAESI Act until such encumbrances are cleared.
