SC: Mere Dispute on Monetary Demand Doesn’t Attract Offence of Criminal Breach of Trust - 04.01.2023

Supreme Court has held that even if complainant is of opinion that monetary demand or claim is incorrect and not payable, an offence under section 405 IPC is not constituted in absence of evidence to establish action that are in violation of any law, or legal contract touching discharge of trust.
