Ker HC: Investigation Into Non-Cognizable Offence w/o Magistrate’s Order Renders Entire Probe Faulty - 08.12.2022

Kerala High Court has held that Section 155(2) of CrPC prohibits commencement of an investigation by police without orders from Magistrate in cases where only non-cognizable offences are alleged, and violation of same renders the investigations illegal from the inception.
