Cancelling allotment for non-payment of installments towards delayed construction constitutes unfair trade practice

In a case where the Complainant stopped depositing installments towards a flat for failure to complete construction within the stipulated time, the Tribunal held the Respondent's act of cancelling the allotment to be an unfair trade practice. Despite demands for information by the Complainant, the Respondents had failed to respond to her communications and keep her apprised about the progress made. The Tribunal held the Complainant to be justified in stopping payment of further installments. Though it had authority to award compensation to the Complainants, the Tribunal could not compel the Respondents to grant physical possession of the flat to the Complainant.
