HC declines interfering in CCI notice against tyre manufacturers

A petition to halt the Competition Commission of India notice against five leading tyre companies for indulging in cartelisation in the Indian market was dismissed. CCI had previously ordered an investigation by the Director General into the conduct of the tyre manufacturers which revealed the manufacturers to have colluded in fixing the sale price of tyres. Soon after, notice was sent to the companies as well as certain individuals. The petitioner contested the notice for being premature as final determination of contravention under Section 27 of the Competition Act 2002 was not complete. The Court ruled that the matter should have been raised before the CCI itself, before the higher courts were approached.
