Madras HC: Manifest Intention to Arbitrate is Sine Qua Non for Filing Application Under S.9 - 22.04.2022

Madras High Court has ruled that manifest intention to arbitrate is a sine qua non for filing an application under Section 9 of the Arbitration & Conciliation Act, 1996 before the initiation of the arbitration. No interim relief can be approved if the intention to arbitrate is missing.
