Gujarat HC: There Cannot Be Deemed Waiver of Section 12(5) of A&C Act - 12.04.2022

Gujarat High Court has held that unless the embargo placed under Section 12(5) of the Arbitration and Conciliation Act, 1996 is waived by the parties, the provisions of Section 12(5) of the Act would persist to be attracted.
