Orissa HC: Right of Accused to Recall Witnesses u/s 311 CrPC Cannot be Denied - 07.03.2022

Orissa High Court has ruled that the right of an accused to recall witnesses under Section 311 of the Code of Criminal Procedure, 1973 cannot be denied only because there exists a right of prosecutrix under Section 33(5) of the Protection of Children from Sexual Offences Act, 2012. The said provision requires the Special Court to ensure that the child (prosecutrix) is not called repeatedly to testify in the court.
