Bombay HC: Affidavit Mandatory for Application Seeking Leave to Defend under Sec 43(4) of MRCA - 28.01.2022

Bombay HC restated that in absence of affidavit, application for leave to defend would not enable a petitioner to claim benefit of Section 4 of Limitation Act. The Court concludes that application without affidavit would not satisfy the condition of Section 43 of Maharashtra Rent Control Act (MRCA).
