Gujarat HC: Maximum Limit of 90 Days for Filing Written Statement Directory Not Mandatory - 27.01.2022

Gujarat High Court has held that the maximum limit of 90 days for filing the written statement as under Order VIII Rule 1 of Code of Civil Procedure, 1908 is directory and not mandatory in nature. However, the Courts must exercise this discretion sparingly and not in the routine course.
