SC: Complaint Filed Under Section 138 NI Act Filed on Behalf of Company Not Liable to be Dismissed - 11.11.2021

Supreme Court has held that a complaint filed on behalf of a company under Section 138 of the Negotiable Instruments Act, 1881 is not liable to be dismissed for the sole reason that it stated the name of the Managing Director first followed by the company's name. The Court has held that though this format may not be perfect it cannot be termed defective.
